Maturity Indicator Terms of Use

These Terms of Use govern your access to and use of the Glider Technology Maturity Indicator tool (the “Tool”) available at www.glidertech.com/asset-intelligence-maturity-indicator-assessment/. By accessing or using the Tool, you agree to be bound by these Terms of Use. If you do not agree, you must not use the Tool.

1.1 WHO WE ARE

The Tool is operated by Glider Technology Limited, a company registered in England and Wales (company number 08248127) with its registered office at Mentor House, Ainsworth Street, Blackburn BB1 6AY (“Glider”, “we”, “us”, “our”).

1.2 INTELLECTUAL PROPERTY

The Tool and all content within it, including without limitation, the assessment methodology, question set and database of questions, scoring system, scoring logic, algorithms, outputs, reports, composite marks, coined phrases, signature visualisations, and all associated text, graphics, and software are the exclusive intellectual property of Glider Technology Limited and are protected by copyright, database right, trade mark rights, and all other applicable intellectual property laws (collectively, “Glider IP”).

Nothing in these Terms of Use transfers any intellectual property rights to you. You acquire no licence or right in the Glider IP other than the limited right to use the Tool as expressly permitted under clause 1.3.

Asset Intelligence Maturity Indicator™, Asset Intelligence Maturity Model™, and the associated signature visualisations are trade marks of Glider Technology Limited. All rights reserved. Unauthorised use of these marks is prohibited.

1.3 PERMITTED USE

We grant you a personal, non-exclusive, non-transferable, revocable, limited licence to access and use the Tool solely for the purpose of conducting a self-assessment of your own organisation’s information management maturity.

You may not use the Tool for any other purpose without our prior written consent.

1.4 PROHIBITED CONDUCT

You must not, and must not permit any third party to: (i) copy, reproduce, download, scrape, crawl, or extract any part of the Tool or the Glider IP by any automated or manual means; (ii) reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, scoring logic, algorithms, weighting methodology, or database structure underlying the Tool; (iii) use any part of the Tool or the Glider IP to create, develop, train, or improve a competing or derivative tool, product, service, or methodology; (iv) reproduce, redistribute, publish, or communicate any part of the Tool or the Glider IP to any third party without our prior written consent; (v) remove, obscure, or alter any copyright notice, trade mark, database right notice, or other proprietary marking appearing on or within the Tool; or (vi) use the Tool in any manner that infringes our intellectual property rights or those of any third party.

1.5 OUTPUT DISCLAIMER

The outputs generated by the Tool (“Outputs”) are indicative only. They are provided for general information purposes and are based solely on the responses you submit. They do not constitute professional advice of any kind, including without limitation technical, legal, regulatory, or consultancy advice.

Outputs do not represent a full or comprehensive assessment of your organisation’s capabilities, risks, or compliance position. You must not rely on any Output as the sole basis for any business, operational, or investment decision.

We make no representation or warranty (express or implied) as to the accuracy, completeness, fitness for purpose, or reliability of the Tool or any Output.

1.6 LIABILITY

To the fullest extent permitted by applicable law, Glider excludes all liability to you for any loss or damage arising out of or in connection with your use of the Tool or any Output, including without limitation: (i) loss of profit, revenue, business, contracts, or anticipated savings; (ii) loss of goodwill or reputation; (iii) loss or corruption of data; and (iv) any indirect, special, or consequential loss or damage of any kind.

Nothing in these Terms of Use limits or excludes Glider’s liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by applicable law.

1.7 THIRD-PARTY RIGHTS

A person who is not a party to these Terms of Use shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms of Use.

1.8 GOVERNING LAW AND JURISDICTION

These Terms of Use and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably submits to the exclusive jurisdiction of the courts of England and Wales to settle any dispute arising out of or in connection with these Terms of Use.

1.9 CHANGES TO THESE TERMS

We reserve the right to update or amend these Terms of Use at any time. The date at the top of this page reflects the date of the most recent update. Your continued use of the Tool after any such update constitutes your acceptance of the revised terms.
